Запропоновано аналіз конфліктогенних факторів, які спонукають до дискусій, окреслено позицію автора щодо державотворчої перспективи аргументацій, де константою і вихідною позицією є конституційна норма. In the article the issue of the correlation of constitutional norm and public discussions, connected with language rights in Ukraine, is considered in categories and concepts of sociolinguistics. The analysis of conflict factors that cause to the discussions is offered, position of author is outlined in relation to the state-creative prospect of argumentations, where a constitutional norm has constant and initial position. It is marked that the intralingual factors of argumentation of language rights in Ukraine remain foremost in the circle of the questions discussed by specialists. But society is concentrated on the discussion of different variants of languages' Law in Ukraine, and also legislative acts, where the functions of official language are regulated — in information, in an advertisement, in education etc. The imperative norms of Constitution come into question in connection exactly with the functions of language, where state-creative and communicative statuses of languages in Ukraine are divided. Polarity of ideology in discussions causes to the conflicts, but not to the harmony in the public ideas. In the article the conflict factors, their reasons and possible decisions of language conflict as necessary pre-condition to realization of constitutional norm in relation to language rights in Ukraine are analysed. uk Інститут мовознавства ім.
