В статье рассматриваются проблемные вопросы взаимодействия принципов права и принципов морали в ценностном измерении. Сделан вывод о динамическом влиянии права и морали на развитие общественных отношений в современных правовых системах.
The article deals with the issue of interaction between legal and moral principles of value dimension. The principles of law are closely linked and interact to the legal one. They are characterized by signs of unity and mutual influence. The legal and moral principles are characterized as basic requirements and provisions, which define thebasis for the functioning of law and morality; ensure their unity and independence of influence in society. However, only the law can be identified as systematic, normative, logical sequence and state support up to coercion. The binding and systematic law enables, first, to determine the system of general principles, cross-industry and industry, and secondly, to determine necessarily stable character, securing them in the regulations. The system of morality is conservative as reflecting sustained human ideas of good and evil. It is important for understanding the unity, diversity, interaction and relationship of legal and moral principles of the system. It is implemented in the regulation of social relations. Through their regulatory process it gets awareness, purposefulness and meaningfulness. The overall goal of law and morality is a dynamic influence on the development of public relations, forming civilized forms of communication and effective regulation of a wide range of contemporary issues. At the same time legal act and morality syncretic focused on respect to the national legal traditions, cultural heritage, legal, moral and ethical principles, value relationships, and therefore desired the introduction of their content in the actual conduct of civil society actors. At the conclusion it is fased the dynamic effect of law and morality onto development of social relations in modern legal systems.
