В статье рассмотрены некоторые аспекты применения сравнительно-правового метода в разработке концепции «политика права», а также в политико-правовых отраслевых исследованиях.
The article is dedicated to the issue of increasing attention to law policy at the modern jurisprudence on the basis of history, theory and methodology. The scientists find the root in pre-revolitional jurisprudence. Referring to the period the new scientific concept of Comparative Legal Method at the Law Policy was worked out. Their parallel development explains the interaction and relevance. It is necessary to state that pursuant to the extend scientist Yu. S. Gambarov, the Comparative legal method is used as dominant method of Law Policy legal school. There were two understandings of comparative legal method: 1) genetic method that means comparing the different state and law phenomenon in different historical conditions. Nowadays it’s the area of state and legal history researches; 2) typology method is used at the area of the modern comparative law. It supposes to compare different state and legal phenomenon of modern time. Pursuant to F. V. Taranovsky the main aim of comparative law is helping and co-working with the law policy. The article also investigates the aspects of comparative method which is used for the purpose of law policy. The author of the article try to apply the dialectic rules on relevance of the comparative law and the law policy as scientific sphere.
