В работе анализируется система общих принципов права Европейского Союза, выделяются и раскрываются конкретные составляющие этой системы и прослеживаются тенденции их дальнейшего развития. This Article stipulates the General principles of law as important source of European Union law. Grounded, that since 50th of ХХ century principles of law in the legal systems of the European countries developed under integration processes in European communities, and European Union, created on their basis. Term «general principles of law, peculiar to the legal systems of member-states» of European Union was formulated as early in constituent acts of three European communities — Agreement establishing the European community of coal and steel 1951, Agreement establishing the European community and Agreement establishing the European community of atomic energy (both 1957). But neither the concept of general principles of law, nor their maintenance constituent agreements did not gave expose. In practice it resulted in that a task on filling of this blank was laid on the European Court of Justice. In the process of its activity he formulated some fundamental legal principles which had unwritten character and defined them as higher norms in the European Union legal system. Thus a Court used principles, common for law order of member-states and on practice of functioning of institutes and other bodies of European Union, and also on principles and customs of international law. Such judicial practice assisted that soon general principles of law were acknowledged and fixed in constituent acts which made alteration and additions in primary agreements. Now to basic principles of European Union law behave: principle of legal definiteness, principle of legal expectations, principles of proportion and subsidiary, principle of equality, principle of defense of basic human rights. uk Інститут держави і права ім.
