| description | We studied the insolvency laws of countries such as Canada, Britain, France, Italy and Japan in terms of its versatility and flexibility, as an indicator of an efficient system of bankruptcy. It was established that the legislation of those countries formed of different mechanisms of initiation of the proceedings and the use of reorganization procedures, depending on the value of the debtor and its place in the economy. It was determined that in Ukraine size of indisputable monetary claims should be based on the classification of business entities under Art. 55 of the Commercial Code of Ukraine.

Исследовано законодательство о несостоятельности, действующее в Канаде, Великобритании, Франции, Италии и Японии, с точки зрения его универсальности и гибкости, эффективности системы институт банкротства. Установлено, что в этих странах в процедуре банкротства сформированы различные механизмы возбуждения производства по делу и применения реорганизационных процедур в зависимости от величины должника и его места в экономике страны. Определено, что в Украине расчет размера бесспорных денежных требований следует осуществлять на основе классификации субъектов хозяйствования, предусмотренной ст. 55 Хозяйственного кодекса Украины. Досліджено законодавство про неспроможність, чинне у Канаді, Великій Британії, Франції, Італії та Японії, з точки зору його універсальності та гнучкості, ефективності системи інституту банкрутства. Встановлено, що у цих країнах у процедурі банкрутства сформовані різні механізми порушення провадження у справі та застосування реорганізаційних процедур залежно від величини боржника та його місця в економіці країни. Визначено, що в Україні розрахунок розміру безспірних грошових вимог варто здійснювати на основі класифікації суб’єктів господарювання, передбаченої ст. 55 Господарського Кодексу України. V.
