По идее, запрет оправдан, если его нарушение влечет наступление неблагоприятных экономических и других последствий. В статье предлагается, при условии соблюдения соответствующей процедуры, наделять хозяйствующих субъектов правом действовать вопреки запрету при условии компенсации потенциальных потерь. Ущерб предотвращается совместными действиями сторон. Чинне право — це зведення мислимих і немислимих заборон. Заборона є виправданою, якщо її порушення спричиняє настання несприятливих економічних та інших наслідків. У статті пропонується наділяти суб’єктів господарювання правом діяти всупереч забороні при дотриманні відповідної процедури та за умови компенсації потенційних втрат. Збиткам запобігають спільні дії сторін. V.
