Quality of a legislation in a sphere of city planning is a serious reason for investors to make decision about an investing in a building sector of economy of any country. A status of construction market in Ukraine is not sustainable as a result of some causes. The main task of the article is to observe completeness and quality of a legal regulation of permissive relations in a sphere of town planning. Author defined a list of appropriate permissive documents and analyzed their legal regime. There are such building permits as permit for building works, notifications about beginning of building works and beginning of preparing works, permit for building of constructions and objects of road service, gasoline stations, reconciliation of projects for building, reconstruction and repairing of roads, railway moves, complexes of road service and other constructions, reconciliation of programs and projects of architectural, building and landscape converting, earthen works on national monuments, their territories, in their protecting territories, in their security zones and also programs and projects whose realization may affect objects of cultural heritage and permit for building in a free custom zone. The legal regime of these documents (excluding permit for building works) are unsatisfactory. A legislation has only some common norms about their legal regime. So the author proposed possible trends of an improvement of permissive legislation in a sphere of city planning. The legal regulation of such permissive relations need to be more detailed for protection public interests. A serious problem is a disintegration of norms about permissive relations in a sphere of protection of cultural heritage and such norms in a legislation about town planning. Permissive relations between organs of protection of cultural heritage and customer of building works are not regulated in appropriate way in Ukrainian legislation. Author analyzed coordination of such norms and made some proposals for their improvement.

Предложены возможные направления усовершенствования разрешительного законодательства в сфере градостроения. Рассмотрены нормы законодательства об охране памятников культуры в части согласованности с нормами разрешительного законодательства. Визначено перелік дозвільних документів у сфері містобудування, проаналізовано повноту і якість правового регулювання відповідних дозвільних відносин. Запропоновано можливі напрями удосконалення дозвільного законодавства у галузі містобудування. Розглянуто норми пам’яткоохоронного законодавства в частині узгодження з нормами дозвільного законодавства. V.
