The article deals with current challenges foreign investors are likely to face when investing in Ukraine. The article undertakes periodization of the development of foreign investment treatment in Ukraine through the review of amendments into the foreign investment legislation and changes in its application. The author raises the most actual issues of foreign investing in Ukraine, such as instability of investment legislation, inadequacy of the protection of investors’ rights (due to the corrupted judicial system; prevalence of «raiding» practices; the risk of forcible takeovers («re-privatisation») without, clear standard of compensation; erroneous legislative norms). The article seeks to propose the ways of minimizing such investment risks through the gradual harmonization of the Ukrainian investment laws with acquis communautaire of the European Community, referring disputes involving protection of investment rights for resolution to international fora (the European Court of Human Rights, the International Centre-for Settlement .of Investment Disputes of the World Bank). The author draws conclusions with respect to subsequent trends of development of foreign investment law in Ukraine. |

Статья посвящена текущим проблемам, с которыми чаще всего сталкиваются иностранные инвесторы в Украине. Произведена периодизация развития режима иностранного инвестирования в Украине посредством обзора изменений инвестиционного законодательства и практики его применения. Осуществлена постановка наиболее актуальных проблем иностранного инвестирования в Украину, таких как нестабильность инвестиционного законодательства, недостаточный уровень защиты прав инвесторов (вследствие коррумпированности судебной системы, распространенности практики «рейдерства», риска принудительного изъятия («реприватизации») имущества при отсутствий четкого стандарта компенсации, несовершенства законодательных, норм). Предложены способы снижения инвестиционных рисков путем постепенного сближения инвестиционного законодательства Украины с правом и стандартами Европейского Сообщества (acquis communautaire), обращения к международным органам по разрешению споров, связанных с защитой прав инвесторов (Европейский суд по правам человека, Международный центр по разрешению инвестиционных споров при Мировом банке). Предложены выводы относительно последующих перспектив развития законодательства об иностранном инвестировании в Украине. Стаття присвячена поточним проблемам, з якими найчастіше стикаються іноземні інвестори в Україні. Проведено періодизацію розвитку режиму іноземного інвестування в Україні через огляд змін інвестиційного законодавства та практики його застосуванні. Здійснено постановку найбільш актуальних проблем іноземного інвестування в Україну, таких як нестабільність інвестиційного законодавства, недостатній рівень захисту прав інвесторів (через корумпованість судової системи, поширеність практики «рейдерства», ризик примусового вилучення («реприватизації») майна за браком чіткого стандарту компенсації, недосконалість законодавчих норм). Запропоновано способи зниження інвестиційних ризиків шляхом поступового зближення інвестиційного, законодавства України з правом і стандартами Європейського Співтовариства (acquis communautaire), звернення до міжнародних органів з вирішення спорів, пов’язаних-із захистом прав інвесторів (Європейський суд з прав людини, Міжнародний центр з вирішення інвестиційних спорів Світового банку). Запропоновано висновки щодо подальших перспектив розвитку законодавства про іноземне інвестування в Україні. V.
