Based on analysis it is offered to specify the sphere of the above legislation effect in order to separate it from the sphere of effect of legislation on protection of rights to intellectual property objects. Проведен анализ зарубежного и национального законодательства, научных подходов, правоприменительной практики относительно определения и понимания сущности недобросовестной конкуренции и ее отграничения от других смежных правонарушений. На основе анализа предлагается уточнить, сферу действия законодательства о защите от недобросовестной конкуренции с целью отграничения ее от сферы действия законодательства об охране прав на объекты интеллектуальной собственности. Проведено аналіз зарубіжного вітчизняного законодавства, наукових підходів, правозастосовчої практики стосовно визначення та розуміння сутності недобросовісної конкуренції та її відмежування від інших видів суміжних правопорушень. На підставі аналізу пропонується уточнити сферу дії законодавства про захист від недобросовісної конкуренції з метою відмежування її від сфери дії законодавства про охорону прав на об`єкти інтелектуальної власності.
