The comment focuses on the issues of national economic security of Ukraine vis-a-vis threatening influx of foreign capital in the most vulnerable sectors of the economy. The comment analyses provisions of public international law, WTO law, the law of the European Community as well as provisions of the U.S. domestic legislation and practice of its enforcement with respect to foreign investment restrictive measures. As a result of research, the comment sets forth proposals as to amendment of the Ukrainian current legislation with the view of improving efficiency of the protection of national economic security interests. Статья посвящена вопросам защиты национальной экономической безопасности Украины от опасной экспансии иностранного капитала в наиболее уязвимых отраслях экономики. Статья анализирует поло­жения международного публичного права, права ВТО, права Европейского Сообщества, а также националь­ного законодательства и практики США в отношении ограничений на осуществление Капиталовложений инвесторами из-за рубежа. По результатам исследова­ния сформулированы предложения по усовершенствованию действующего законодательства Украины с целью повышения эффективности защиты интересов национальной экономической безопасности. Стаття присвячена питанням захисту національної економічної безпеки України від небезпечної експансії іноземного капіталу у найбільш вразливих галузях економіки. Стаття аналізує положення міжнародного публічного права, права СОТ, права Європейського Співтовариства, а також національного законодавства ї практики США щодо обмежень на здійснення капіталовкладень інвесторами з-за кордону. За результатами досліджень сформульовано пропозиції з удосконалення чинного законодавства України з метою підвищення ефективності захисту інтересів національної економічної безпеки. V.
