Огляд нормативно-правової бази України в частині регулювання складових ядерної захищеності

The article presents an analysis of the national regulatory and legal framework in the area of nuclear security, taking into account the current challenges caused by the ongoing hostilities on the territory of Ukraine since the beginning of the full-scale invasion by the russian federation. In particular, gaps have been identified in the legislative and regulatory framework governing key components of a security regime for nuclear facilities, nuclear materials, radioactive waste, and radiation sources, such as physical protection, cybersecurity, information security, design basis threat, and emergency response. The current legislative documents, resolutions of the Cabinet of Ministers of Ukraine, regulatory documents of the State Nuclear Regulatory Inspectorate of Ukraine, other departmental provisions, and their compliance with international standards, in particular, documents of the International Atomic Energy Agency and provisions of the Convention on the Physical Protection of Nuclear Material, have been analyzed. Special attention is paid to implementing the requirements of the General Security Provisions for Nuclear Facilities, Nuclear Materials, Radioactive Waste, and Other Radiation Sources approved by Order No. 1071 of the State Nuclear Regulatory Inspectorate of Ukraine dated 27 September 2024 and registered with the Ministry of Justice of Ukraine under No. 1696/43041 on 12 November 2024, as the first attempt to systematize approaches to the development of a national nuclear security regime. The analysis revealed significant regulatory gaps and proposed specific directions to improve the current regulatory framework of Ukraine, in particular, developing a number of documents on the rules for the physical protection of radioactive waste and other radiation sources, facility design basis threats, implementing and maintaining a nuclear security regime in the operators’ practices. The application of the above documents will promote the establishment of an effective national nuclear security regime harmonized with international standards of the International Atomic Energy Agency and provisions of the Convention on the Physical Protection of Nuclear Material.
