The article presents an analysis of the national regulatory and legal framework in the area of nuclear security, taking into account the current challenges caused by the ongoing hostilities on the territory of Ukraine since the beginning of the full-scale invasion by the russian federation. In particular, gaps have been identified in the legislative and regulatory framework governing key components of a security regime for nuclear facilities, nuclear materials, radioactive waste, and radiation sources, such as physical protection, cybersecurity, information security, design basis threat, and emergency response.
The current legislative documents, resolutions of the Cabinet of Ministers of Ukraine, regulatory documents of the State Nuclear Regulatory Inspectorate of Ukraine, other departmental provisions, and their compliance with international standards, in particular, documents of the International Atomic Energy Agency and provisions of the Convention on the Physical Protection of Nuclear Material, have been analyzed. Special attention is paid to implementing the requirements of the General Security Provisions for Nuclear Facilities, Nuclear Materials, Radioactive Waste, and Other Radiation Sources approved by Order No. 1071 of the State Nuclear Regulatory Inspectorate of Ukraine dated 27 September 2024 and registered with the Ministry of Justice of Ukraine under No. 1696/43041 on 12 November 2024, as the first attempt to systematize approaches to the development of a national nuclear security regime.
The analysis revealed significant regulatory gaps and proposed specific directions to improve the current regulatory framework of Ukraine, in particular, developing a number of documents on the rules for the physical protection of radioactive waste and other radiation sources, facility design basis threats, implementing and maintaining a nuclear security regime in the operators’ practices. The application of the above documents will promote the establishment of an effective national nuclear security regime harmonized with international standards of the International Atomic Energy Agency and provisions of the Convention on the Physical Protection of Nuclear Material. |

У статті наведено аналіз національної нормативно-правової бази у сфері ядерної захищеності, з урахуванням нинішніх викликів, зумовлених веденням бойових дій на території України з початку повномасштабного вторгнення військ рф. Зокрема виявлено прогалини в законодавчому та підзаконному регулюванні ключових складових режиму захищеності ядерних установок, ядерних матеріалів, радіоактивних відходів і джерел іонізуючого випромінювання, як-от: фізичний захист, кібербезпека, інформаційна безпека, проєктна загроза та реагування на надзвичайні ситуації. Проаналізовано чинні законодавчі акти, постанови Кабінету Міністрів України, нормативно-правові акти Державної інспекції ядерного регулювання України, інші відомчі положення та їх відповідність міжнародним стандартам, зокрема документам Міжнародного агентства з атомної енергії, і положенням Конвенції про фізичний захист ядерного матеріалу. Особливу увагу приділено впровадженню вимог Загальних положень захищеності ядерних установок, ядерних матеріалів, радіоактивних відходів, інших джерел іонізуючого випромінювання, затверджених наказом Державної інспекції ядерного регулювання України від 27.09.2024 № 1071 та зареєстрованих в Міністерстві юстиції України від 12.11.2024 № 1696/43041, як першої спроби систематизувати підходи до формування державного режиму ядерної захищеності. У процесі аналізу виявлено суттєві нормативні прогалини та запропоновано конкретні напрями вдосконалення нинішньої нормативної бази України, зокрема створення низки документів щодо правил фізичного захисту радіоактивних відходів та інших джерел іонізуючого випромінювання, об’єктової проєктної загрози, впровадження і підтримання режиму ядерної захищеності у практичній діяльності операторів. Результати застосування вищезазначених документів сприятимуть побудові ефективного державного режиму ядерної захищеності, гармонізованого з міжнародними стандартами Міжнародного агентства з атомної енергії і положеннями Конвенції про фізичний захист ядерного матеріалу.
